1.Acceptance of Terms

By accessing, browsing, or using Fact or Myth? (the “Service” or “Web App”), operated by Nesberry Apps (“we”, “us”, or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use the application.

2.Edutainment Purpose & Medical/Professional Disclaimer

All questions, facts, answers, and explanations within Fact or Myth? are curated solely for general informational, educational, and entertainment purposes.

• Not Professional Advice: Information regarding human biology, nutrition, medicine, pharmacology, or physical safety must not be construed as medical diagnosis or professional counsel. Always consult a licensed healthcare provider for health matters.
• Evolving Science: Scientific understanding changes as new discoveries occur. While our facts are meticulously vetted, historical consensus and scientific paradigms may evolve over time.

3.AI Synthesizer & User-Generated Cards

The application provides an AI Infinite Synthesizer feature that enables players to generate customized trivia cards using large language model APIs (e.g., Google Gemini):

• Large language models may occasionally hallucinate or generate plausible-sounding inaccuracies.
• Nesberry Apps does not pre-screen or guarantee the factual integrity of cards synthesized through personal user AI queries.
• You are solely responsible for ensuring your prompts comply with API provider terms of service and do not generate abusive or harmful content.

4.Intellectual Property Rights

The Fact or Myth? web application, including its source code, UI design, sound synthesizers, logos, visual animations, and curated card database compilations, are the intellectual property of Nesberry Apps and protected by applicable copyright and trademark laws.

Raw historical dates and scientific laws in the public domain are free for everyone, but copying, re-selling, scraping, or redistributing our curated database, visual artwork, or application code without written consent is strictly prohibited.

5.Community Support & Patron Passes

Players may choose to “Fuel Tomorrow's Deck” by contributing coffee or matcha tips to the indie developer:

• Contributions are voluntary gifts made to assist hosting expenses, research subscriptions, and continued free access for all players.
• Patron badges and celebratory passes are tokens of appreciation and do not constitute corporate equity, financial dividends, or commercial licenses.
• Donations are processed via reputable third-party platforms (e.g. Buy Me a Coffee / Stripe) under their respective payment terms.

6.Acceptable Use & Prohibited Conduct

When using the Service, you agree not to:

• Engage in automated scraping or rate-limit circumvention against our hosting infrastructure.
• Attempt to decompile, reverse engineer, or extract trade secrets from the compiled application bundle.
• Use the application to distribute malicious payloads, viruses, or spam.

7.Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NESBERRY APPS DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL NESBERRY APPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
